How statutory redundancy pay is worked out

An employee with at least 2 years' continuous employment who is dismissed by reason of redundancy is entitled to a statutory redundancy payment (Employment Rights Act 1996, sections 135 and 155). Each complete year of service, counted back from the end of employment and up to 20 years, gives 1.5 weeks' pay for a year in which you were 41 or over, 1 week from 22 to 40, and half a week under 22 (section 162).

A week's pay is limited to £751 when the calculation date is on or after 6 April 2026 (£719 from 6 April 2025). If your employer ended your employment, the calculation date can be moved to the end of your statutory minimum notice (section 145(5)): this can bring you to 2 years.

To keep your right, a written claim must reach your employer within 6 months of your last day (section 164). This calculator shows that date and a sending date that leaves 10 days for the letter to arrive.

Example

Born on 10 March 1981, started on 1 May 2016, notice received on 1 April 2026 and worked, last day 30 June 2026, £800 a week: 10 years counted (4 at 41 or over, 6 from 22 to 40), 12 weeks at £751 = £9,012.00. The written claim must reach the employer by 29 December 2026; send it by 18 December 2026.
